On September 8, 2003, the Securities and Exchange Commission (SEC) filed a Complaint for Injunctive and other relief against Viatical Capital, Inc., Life Investment Funding Enterprises, Inc., Charles Douglas York and Robert K. Coyne. On September 12, 2003, Judge Steven D. Merryday of the federal district court for the Middle District of Florida entered a Temporary Restraining Order and Other Emergency Relief and an Order Appointing Receiver, appointing David M. Levine as receiver for Viatical Capital, Inc., Life Investment Funding Enterprises, Inc., Resource Funding Group, Inc., RFG Trust, Viatical Marketing, Inc., Investment Capital Marketing, Inc., and Premier Investment Capital, Inc. d/b/a Life Settlement Network (collectively , "VCI"). Thereafter, upon motion filed by the Receiver, the Court appointed Mr. Levine the Receiver for the various limited liability companies into which investors' money was sent. See "Lawsuits Filed" Link.
On October 2, 2003, the Court authorized employment of the firm of Tew Cardenas, LLP (www.tewlaw.com) as attorneys for the Receiver, and Grant Thorton, as forensic accountants for the Receiver.
Since being appointed, Mr. Levine and his professionals have undertaken extensive efforts to investigate the activities of VCI and its principals in order to recover and protect assets and to pursue recoveries on behalf of the investors who were victims of the VCI fraud. The Receiver has already made distributions to investors and creditors totaling 55% of their allowed claims. (See Letters, Recent Developments, and Lawsuits Filed links.) Mr. Levine has posted this website to provide information for investors who lost money investing in insurance policies sold by VCI and its brokers.
